Cases of multiple tubes from picsfordesign.com being shared

We get letters from our customers that contain information about multiple cases of numerous images from picsfordesign.com being shared. For two weeks we have been monitoring the situation and taking action, so we are now ready to comment on it.

Who does it

It's a small group women from Florida and other US states (it's information that's openly available, we do not collect it n any special way).

Why they are doing it

Well, they are fighting against our Themis Panda, believe it or not, and this is what they proclaimed. However, the fight of adult females against a drawn character is the kind of diagnosis that's out of our competence, because this should be determined by qualified professionals only.

Who may need shared tubes and why

Everyone must be interested to see the full version of our pictures, especially in PSD format, because PicsForDesign sells beautiful pictures with plenty of unique layers that can be enabled or disabled. We understand how amusing it can be for many and do not prohibit to download the pictures that have been shared. The thing is, however, they are good for nothing except for viewing them in such cases. PicsForDesign keeps track of the purchase history for every customer and we know exactly who purchased what and when. If we see a design of a website or blog, or a tag, we check the license and the owner to see if they purchased that picture. If they did not, they will have to remove the design or the tag. So, taggers do not really need shared tubes for anything.

Can sharing harm our store and honest customers?

Nope, no matter how hard they try and how much they share. We love tags and animation that our taggers send, we have regular customers, affiliate forums, we give gifts, hold contests, develop the tagger's community and try to make everyone welcome and comfortable. All this can work only if the tubes are purchased legally and used according to the license terms of use. Our sales have not decreased because of that.

How does PFD protect its artists?

Our artists are the ones who suffer form all the sharing the most. No one enjoys seeing their pictures uploaded to a file sharing server, after all the hard work and effort they put into it. This is why we came up with special software nicknamed Panda, which allows determining with 100% certainty which account the picture has been purchased from. It's helping us a lot at the moment. The accounts of those violating license terms of use are blocked, we send abuse reports whenever there are any links being shared, and they are removed shortly by those websites. Piracy is something no website condones, not even file sharing websites. Of course, it will not solve the problem of piracy once and for all, but it significantly reduces the losses our artists may suffer because of sharing.

What you can do for us and our artists

If you noticed any cases of sharing, we would kindly ask you to do the following:
1) If this is a group where you can post messages – express your opinion on what's going on;
 2) If it's a file sharing website – send us a letter that contains links to the tubes shared so that we could file an abuse report and ask to remove the links. You can send it to panda@picsfordesign.com. You can be sure your message will remain anonymous.

Do not take any notice of people trying to blame you for spying or twist your arms. You are an honest and responsible customer, and very often a talented artist or designer. You have a right to express your opinion to those who steal openly, so not be afraid to say what you really think. Piracy is impossible to eradicate, as today it has become a part of our society. However, pirates do need to be told who they really are and put on the spot. They have to be made aware they do not belong to the society of honest talented people, because they are nothing but petty thieves unable to fill their own lives with any meaningful activities and hiding their uselessness under the glorious word "rebel raiders".

Always yours,
PicsForDesign.com Team

Twin, are you a lawyer for

Twin, are you a lawyer for nemesis? What else is not clear to you from what we said here? You can read the thread again if you keep forgetting the key points, because you are repeating what you  already said and we do not feel like doing it for your entertainment. Funny how thieves try to blame honest people when they feel someone is insulting their honorable personalities by following the rules and preventing them from breaking any. It's it time to stop making a laughingstock out of yourselves. We see no point in whatever it is you are trying to do or prove here, because we will never stop protecting our artists from pirates as much as we can, and that's all there is to it. If anything is still not clear about our opinion on anything related to piracy, please take the time to review our previous posts and you will be sure to find that info without creating any new senseless posts. Thanks in advance for understanding.

Ms. Anderson, You said you

Ms. Anderson,
You said you are talking about threats and insults to people at your company. But, it would appear to me that you made a threat in the post of you replying to me. And you also made insults in the post replying to Sandra.
So, wouldn't Nemesis have as good a complaint against you and your company, since you are writing on their behalf, as you say you have against her?
How can you tell us that you've handed documentation over to your lawyer when you yourself, have done the same thing your accusing her of?
Also, can you give me the law that states its illegal to insult someone as I'm not familiar with that one. Thank you.

Lady (assuming you are a lady), we already said we have and will delete comments that make decent people wish they'd never read all that dirt. Your urges that go like "hooray, let's steal!" are more than just brazen and definitely unwelcome. This is why you no longer can access our PFD store. Don’t write any nasty things here, just express your opinion and have some decency. As you can see, there are may other comments with opinion other than ours not deleted, because people behave themselves decently and avoid screaming at the top of your lungs and using offensive language.

I see you have deleted BOTH

No Twin, that's not exactly

No Twin, that's not exactly right. We already have a case build against nemesis in a nice folder withal the information, officially and legally, our lawyer has it. It's not about sharing, rather than threats and personal insults sent to staff of our company, there isn’t a single word about tubes there.

We are not going to sue anyone for tubes, just in the same way you cannot sue us for anything. We will just protect the rights of our artists using all the tools at our disposal. And believe me when I say this – we have plenty of very efficient and serious methods at our disposal :) In our country there is a very good expression that reflects our indifference towards pirates as a group – do not touch a piece of s*** unless you want to smell the same. In other words, we are not going to start any kind of dialogue with them. They just don’t really bother anyone that much. They shared pictures and exchange them in their small group among just a few people. Good for them, they kept themselves busy with at least something. Meanwhile we keep working, our artists continue drawing and taggers continue sharing their art with us, we exchange positive energy and help each other. If you ask me, I think pirates are just jealous :)

Thank you Julia

Yes dear, the Spanish

Submitted by Nemesis My Ass! (not verified) on Sun, 08/14/2011 - 13:43.

Yes dear, the Spanish pronunciation, not the Hebrew pronunciation as the earlier poster claimed. And the Spanish pronunciation is actually closer to heysoos, or haysoos if you prefer, so soos not zeus would be slightly more accurate. But frankly that isn't the issue so please lets not waste time arguing over a totally moot point and you doing so little to support their argument. I really don't have the time to waste explaining every little thing.

When you write nasty words on

Submitted by Julia Anderson (not verified) on Sun, 08/14/2011 - 13:28.

When you write nasty words on the walls of a store or just swear at the shop assistant, what do you think is going to happen to you right then? Correct, the best you can hope for is being thrown out. We are kinder than that, we will just strip you of the possibility to write anything here. Our customers and artists are creative and honest people, they didn’t sign up for your rudeness and ignorance. All posts that are rude or inappropriate have and will be removed, and their authors have and will be deprived of the possibility to write here again. I suggest discussing the problem constructively.

Let me summarize for you. A person referring to herself or himself as nemesis and her\his accomplice Fiesty had their accounts blocked. File sharing services cooperate with us and remove the shared links within 24 hours or even sooner. PFD works as before, we do updates, our artists draw new works, everything is nice and stable :) Thank you all for being with us!

Calling someone a thief is a

Submitted by Twin (not verified) on Sun, 08/14/2011 - 06:12.

Calling someone a thief is a strong statement. And its also incorrect, unless of course, you have a winning court case with the case number, docket number and transcript record number, which I don't think you have.
Actually, there has never been a case go to court for a psp'er using a PTU tube or scrap kit. I wonder why that is? Could it be because you don't want to be the one to challenge it in case you lose. I mean really. Lets face it. If you win you'll be the hit of the world and every artist will look at you as their hero. BUT, if you lose, you will have cost every artist all the money they would have ever made selling tubes/kits.
The people that buy your art do it because they believe if they use a tube/kit they didn't pay for, its illegal. Right, wrong or indifferent, thats what they believe and thats why they give you their money. They wouldn't give you money if you lost in court now would they? They wouldn't have to. They would be able to use any tube they could get legally and for free.
Just a thought.
